Healthy Chef Delivery Customer Agreement
Welcome to Healthy Chef Delivery™! Your health is our #1 concern. This Agreement is a legal agreement between you and Healthy Chef Delivery™ that states the terms and conditions under which you may receive the Healthy Chef Delivery™ service and use the Healthy Chef Delivery Web site ("healthychefdelivery.com"). If you use the Healthy Chef Delivery™ Service or healthychefdelIvery.com, you agree to these terms and conditions.
The Healthy Chef Delivery™ service is a transaction, information and communication service available to customers who access healthychefdelivery.com. Healthy Chef Delivery™ service currently provides internet online ordering and delivery of meals, prepared food, grocery items; Business to Business delivery service, and may in the future provide additional related services. Healthy Chef Delivery™ may also act as access source for other products and services such as NaturWater or Univera, or other products in the future.
Healthy Chef Delivery™ is a registered trade name with JD Delivery, Inc, an Alberta incorporation. JD Delivery, Inc, is doing business as Healthy Chef Delivery™.
Meals, Prepared foods and Grocery Service and Delivery
Healthy Chef Delivery™ employees or designees will prepare, package and deliver orders placed with the Healthy Chef Delivery™. Delivery will be made to the delivery address identified in your customer profile. Deliveries are only available in the City of Calgary. Prices on the website may change at any time. Payment for all orders and delivery fees are processed at the time of order through a secure ecommerce system. Healthy Chef Delivery™ does not view or have access to any of your credit card information.
Delivery.
Anyone at the delivery address who receives the delivery is conclusively presumed to be authorized to receive the order. If Healthy Chef Delivery™ cannot deliver your order, or must make an additional delivery due to a customer controllable situation, there may be an additional delivery fee. Healthy Chef Delivery™ liability for missing a delivery is limited to delivery at a later agreed time at no additional charge. In Alberta, if inclement weather prevents delivery, the product will be properly stored and delivered to the customer at the earliest possible time.
Unattended deliveries.
If you or a designate is not present to receive your order, it is conclusively presumed that you choose to receive your order as an unattended delivery. If so, your order will be left unattended at your door or other place you designate. Healthy Chef Delivery™ may also choose to leave your order unattended in a convenient location, if an appropriate person is not present to receive your delivery. Healthy Chef Delivery™ is not responsible, and you agree not to hold Healthy Chef Delivery™ or its employees or designees responsible, for any damage or theft that occurs to an unattended delivery. Healthy Chef Delivery™ reserves the right to refuse to leave an order unattended if the driver considers the circumstances to be unsuitable or unsafe for any reason.
Allergies. We recognize that many ingredients can cause severe allergic reactions in some people. Your safety is important to us, and we carefully check our ingredients. We DO NOT GUARANTEE that there are no traces of severe allergens in our items, or that cross contamination will not happen. Even though our foods are produced as labeled, our licensed kitchen facility is not certified to be free from gluten, dairy, soy, shellfish, peanuts, nuts or tree nuts. If you have allergy concerns or have life-threatening allergies please refrain from ordering from Healthy Chef Delivery™.

The nutritional suggestions and/or diets or meal suggestions offered by Healthy Chef Delivery™ or Nutritionist or Natural Food Chefs are not offered or intended to treat, mitigate or cure any type of disease, sickness or weight problem, and should not be used as a substitute for sound medical advice. Neither JD Delivery, Inc, doing business as Healthy Chef Delivery nor any of its directors, partners or staff can be held liable under any circumstances for any illness or health problem that may result from the consumption of its prepared foods or meals. The customer agrees that they are consuming this food at their own risk. We do not guarantee the meals are free from allergens, and clearly state that cross contamination with allergens can occur. Please see our Allergens section above. Healthy Chef Delivery foods and meals are designed to be a part of a healthy lifestyle in conjunction with the services of a licensed healthcare provider. Consult your healthcare provider before taking nutritional supplements or beginning any diet or exercise program. Healthy Chef Delivery does not claim in any way to be 100% organic. Healthy Chef Delivery produces meals using a mixture of natural and organic ingredients. We reserve the right to substitute with conventional product when organic and natural product is not available. We also reserve the right to substitute any item on the day of delivery with a suitable replacement item, if that item is not available on that day. Third Party Information Providers and Merchants. The Healthy Chef Delivery™ service may permit you to order and receive products, information and services from businesses which are not owned or operated by Healthy Chef Delivery™. The purchase, payment, warranty, guarantee, delivery, maintenance and all other matters concerning the merchandise, services or information ordered or received from such businesses are solely between you and such businesses. Healthy Chef Delivery™ does not endorse, warrant or assume any responsibility or liability for such products, information or services including, but not limited to, the accuracy, completeness or usefulness of such information, opinion and advice and the quality and availability of such products or services. Any separate charges or obligations you incur in your dealings with these third parties are your responsibility and are not part of the fee charged for the Healthy Chef Delivery™ service.

Any other use without our prior written permission is strictly prohibited.
Your Account. You agree to provide Healthy Chef Delivery™ with accurate and complete information as required for the Healthy Chef Delivery™ service, including, your name, delivery addresses, and telephone number. Your credit card account number and expiration date is only seen by the secure online ecommerce system, and is not handled or viewed by Healthy Chef Delivery™. You agree to promptly notify Healthy Chef Delivery™ of any change in your Online Customer Data, and go online to make such changes. Upon registration, you will be issued a login ID and password allowing you access to the Healthy Chef Delivery™ service. Your password should be kept strictly confidential.
Age. By registering for the Healthy Chef Delivery™ service, you warrant that you are at least 18 years old. If you are under 18, you may use the Healthy Chef Delivery™ service only with the involvement of a parent or guardian.
Changes in Agreement, Fee Schedule or Healthy Chef Delivery™ services. Healthy Chef Delivery™ may at any time change any of the terms of this Agreement or the Delivery fee. Healthy Chef Delivery™ may discontinue or revise any or all aspects of the Healthy Chef Delivery™ service without prior notice to you. Price and availability of products are also subject to change without notice. We reserve the right to correct online pricing errors. In such event, we reserve the right to correct the pricing error or cancel undelivered orders for such incorrectly priced products.
Internet. Your use of Healthy Chef Delivery™ or the healthychefdelivery.com website and the internet is entirely at your own risk.
Neither Healthy Chef Delivery™ nor any of its Directors, employees, agents, licensors or merchants (collectively, its "Associates") shall be liable for damages of any kind, including, but not limited to, direct, indirect, incidental, punitive and consequential damages, arising from your use of, in inability to use, Healthy Chef Delivery™, Healthychefdelivery.com website, the internet or any other claims related in any way to your relationship with Healthy Chef Delivery™.
Privacy and Security. Your privacy is very important to Healthy Chef Delivery™. Healthy Chef Delivery™ does not sell personal information about individual customers (such as name, address, e-mail address) to third parties, sell or rent lists of customers or use information about individual customers except to provide Healthy Chef Delivery™ service as described below.
Refund/Satisfaction Policy. Your health and happiness is our priority. We use only the freshest and highest quality ingredients to prepare your food and we pack each order with care. As a practice, we do not provide a refund or a return for our food. In the unlikely event of damaged deliveries, suitable exchange or credit on your account is available. Please contact us within 24 hours of receipt for an account credit or a replacement.
